The City of Mountain Home, Arkansas through municipal codes requires that minimum standards be maintained related to the health, safety and welfare of community residents. The police department is responsible for the enforcement of certain codes and will respond to citizen complaints and conduct proactive enforcement. This is not a comprehensive list of all city codes.

FIREWORKS

ORDINANCE # 03-24

It shall be unlawful for any person, firm, or corporation to sell or offer for sale, or to make or manufacture; or to use by shooting, exploding, discharging, firing, or setting off, any type of firework or other explosive, within the city limits; without first obtaining a duly authorized written permit duly issued by the city Fire Marshal or Fire Inspector, and approved by the Fire Chief.

  • All applications for fireworks  permits must be made five (5) days prior to the requested date of discharging the fireworks
  • Permits must be issued only to a certified pyrotechnics technician and the technician will retain custody of the permit
  • Penalty: minimum fine of $75.00 and no more than $200.00

 GARAGE SALES, YARD SALES, PORCH SALES, PATIO, OR LAWN SALES PER RESIDENCE AND $5.00 PER SALE FEE

ORDINANCE # 2009-11

There is a need for limiting the number of garage, yard, porch, patio, or lawn sales an individual in any residential area may have in any one calendar year. 

  • The individual must obtain a permit from the City Clerk or her agent (permit can be obtained by visiting City Hall located at 720 South Hickory, phone 425-5116)
  • The permit fee is $5.00
  • The permit will be issued for a maximum of three calendar days per sale
  • Two permits may be issued in a calendar year per residence
  • The applicant shall sign a statement stating that the yard sale shall be of personal property owned by the person or persons and that the property was not purchased for the purpose of resale
  • The permit with the receipt are to be displayed in a visible location at the sale
  • Two off premise yard sale signs will be permitted; they may be erected  24 hours before the sale and must be removed within 48 hours after the sale
  • Directional signs may not be attached in any manner to sign posts, utility posts, or placed on public right of ways
  • Penalties: first violation up to $25.00, second violation within two years of first violation not less than $50.00, third and subsequent violations occurring within two years of the first violation shall be a minimum of $100.00

ALERT: One of the most common complaints generated during this type of personal sale is the blocking of the street by vehicles. This mostly occurs when both sides of the street are used for parking, leaving only one traffic lane and sometimes less. This type of traffic problem hinders the motoring public and reduces the response time of emergency vehicles should an emergency occur. Although the ordinance does not regulate vehicle parking during the sale, it is recommended the individual obtaining the permit help with parking issues. If you see a parking issue develop, you may suggest that vehicle operator's park on the same side of the street as the sale with the vehicles headed in the same direction of the flow of traffic. For traffic problems that get out of hand, contact the police department for assistance.


HAZARDOUS DRIVING

ORDINANCE # 087

It shall be unlawful for any person to drive any vehicle in a hazardous manner. Hazardous driving shall be defined as follows: 

Cutting onto and across private property to avoid established traffic patterns, intersections, stop signs and stop lights; or driving around corners at such a speed and in such a manner as to cause skidding of tires or sliding of the vehicle; or driving in wet or inclement weather at such a speed and/or in such a manner that normal or proper control of the vehicle cannot be maintained; or driving any vehicle in such a manner as to indicate a reckless disregard for the safety of persons or property


MAINTENANCE OF REAL PROPERTY

ORDINANCE # 2007-27

      

 

There is a need to establish minimum property maintenance requirements and standards to prevent blight, crime and disease, to preserve property values, to increase public confidence in safety, to increase tourism, to facilitate the basic rights of adjacent property owners and citizens to enjoy their surroundings, to fix the responsibility of owners and occupants and to provide for administration, enforcement, and penalties.
  • Any equipment that is unsafe, inoperative, unfit for human use, or unlawful shall not be kept, owned or displayed on properties
  • All accessory  structures, including but not limited to detached garages, fences and walls shall be kept in good repair and free from vines or other vegetation that may grow into or onto an adjoining property
  • A vacant structure unfit for human habitation, occupancy or use shall not be allowed to remain standing
  • Long-term offensive odors to emanate from the property that unreasonably interfere with the ordinary use and enjoyment of neighboring property owners' land shall not be permitted, excluding naturally occurring odors beyond the control of the property owner
  • Premises and exterior property shall be kept free from all used or dismantled household appliances, furniture, vehicle parts, discarded personal property, garbage, junk, scrap, or refuse excepting those structures in building, remodeling or demolition process.
  • A notice by regular and certified mail shall be sent to the occupant, owner, or lien holder of the property containing a seven (7) days' notice to correct the ordinance violation
  • If the ordinance violation is not corrected, the city may take any and all action necessary to correct the ordinance violation, and shall charge the costs thereof to the owner of the real property
  • The city shall be entitled to a lien against the property for all such costs, provided that the lien shall be perfected, imposed, and collected in the time and manner set forth in A.C.A. 14-54-903 and 14-54-904
  • Penalties: shall be fined not less than fifty dollars ($50.00) nor more than one hundred dollars ($100.00)
  • Each act of violation and every day upon which any such violation shall occur shall constitute a separate offense

UNLAWFUL TO CARRY AND FIREARM DISCHARGE PROHIBITED

ORDINANCE # 90-036

It shall be unlawful for an individual to carry a firearm or an air gun within any recreational facility owned by the city. Furthermore, it shall be unlawful to hunt or trap animals within recreational facilities owned by the city. Penalty: maximum fine $250.00.

ORDINANCE # 833

It shall be unlawful to discharge a firearm or an air gun within the boundaries of the city.

  • Unless in self-defense or in the execution of legal process
  • Definition of firearm: an instrument used in the propulsion of shot, shell, or bullets by the action of gunpowder exploded within it; this word comprises but is not limited to rifles, carbines, shotguns, revolvers, and pistols
  • Definition of air gun: an instrument used in the propulsion of a pellet, B-B or any other projectile by the action of air, gas, or spring
  • Penalty: maximum fine $500.00
